1Trip cancellations due to weather will be made by the captain on the day of the trip. Trips may also be cancelled by Shades of Blue Charters due to technical problems. In the event of a cancellation of your charter, Shades of Blue Charters will aim to find another day or boat, but the right is reserved to cancel any bookings made and in the event of such cancellation, no liability shall fall upon Shades of Blue Charters except that any monies paid shall be returned.
2The captain has the right to alter the course or abort the trip at any point in time during a charter should s/he fear the safety of the boat or passengers is in jeopardy for whatever reason. The charter fee will be adjusted to actual length of the trip or a replacement trip on another date will be arranged.
3A booking deposit of $250 is required to secure the booking. Payment of the remaining balance of the charter fee must be made on the day of the charter via credit card. Charter prices include the captain’s fee but not fuel or gratuity. Gratuity for the captain for a job well done is appreciated and payable directly to the captain in cash. The captain will inform the charterer of the fuel expense (gallons consumed x price/gallon for fuel) at the end of the day and will be added to the charter balance to be paid by credit card.
4Charters cancelled by the charterer are subject to Shades of Blue Charters’ cancellation policy.
5Any customs, mooring, and dockage fees are not included in the charter price and shall be paid by the charter guests.
6The charter guests need to take reasonable care of the boat and its equipment and follow the captain’s orders at all times. Any damage caused by charter guests will be the sole responsibility of the guest to repair.
7Charter guests are advised to only take waterproof equipment (cameras, phones etc.) on the boat or store non-water proof items in dry bags. Shades of Blue Charters shall be exempt from liability for any items damaged by water.
8The charter guests can participate in activities such as swimming and snorkeling during the trip at their own risk. No liability or responsibility is accepted for any loss or additional expenses incurred by accident or sickness during these activities. Life vests have to be worn at all times by all passengers during watersports activities in the water. Passengers who are not good swimmers and the parents/guardians of children under 12 need to inform the captain and wear life vests at all times while on the boat and in the water.
9Shades of Blue Charters exercises all reasonable care to see that the boat and equipment when chartered is in every respect in good order, but they shall be exempt from all liability for loss, damage or injury to persons or property however arising and whether occasioned or contributed to by the act, the neglect, default or omission of the owners, their employees or by reason of any defect in or any insufficiency of boat and equipment whether existing at the commencement of a charter or at any other time.
10No animals or pets of any sort may be taken on board.
